There are several options open to you if you are in a dispute with your builder.

If there is an arbitration clause in the building contract for the building works, the parties will have to refer the claim to arbitration and allow the arbitrator to reach a decision on the matters in dispute.

The next matter is to consider (where available) referring the claim to adjudication. This is most likely the swifter and most cost effective route. It is not however legally binding on the parties and if the claim of the adjudicator is not accepted by the parties, court proceedings can be pursued to resolve the dispute. 

An alternative route is mediation. You and your builder will be in a room with a mediator, who is trained to work with parties in dispute to try to facilitate a settlement. The mediator will do all they can to bring the dispute to a satisfactory conclusion for both parties. Mediation has a number of benefits – it is much quicker than taking your case to court, and it is also less costly than a court case would be.

However, there are a couple of issues that may stop you from going down the mediation route. The first is that both parties have to agree to take part. If your builder decides that they do not want to be involved, they do not have to. This leaves you no option but to litigate.
