Building Disputes

Barker Son & Isherwood - Andover, Hampshire

When you decide to enter into a building project, whether a loft conversion, an extension or a new build property it can be an exciting time. You will probably research your tradesmen, get references and obtain quotes and then keep everything crossed that all goes according to plan and on time.

However, sometimes things do go wrong and you can be left with a poorly executed or incomplete building project. Whatever the circumstances of the dispute with your builder, we can help you to bring it to a swift conclusion in a manner that is acceptable to you.

How We Can Help

There are several options open to you if you are in a dispute with your builder. The first is dispute resolution. You and your builder will be in a room with a mediator, who is trained to work with parties in dispute. The mediator will do all they can to bring the dispute to a satisfactory conclusion for both parties.

Mediation has a number of benefits – it is much quicker than taking your case to court, and it is also less costly than a court case would be. However, there are a couple of issues that may stop you from going down the mediation route. The first is that both parties have to agree to take part. If your builder decides that he doesn’t want to be involved, he doesn’t have to. This leaves you no option but to litigate.

In addition, the outcome of mediation is not legally binding and therefore, there is no requirement for you or your builder to comply with the mediator’s decision. This can leave you without a resolution.

Your final option remains to litigate. We will discuss the process and the associated costs with you in detail, so you can make an informed decision about how to proceed.
