The regularity with which tragic stories of deaths on UK roads are reported ought to be enough to eradicate dangerous driving.

But however often, and however loudly, the messages about the potential impact of speeding, or of being distracted or under the influence of drugs or alcohol (for example) are spelled out these incidents continue to happen. And for family members of those killed by dangerous drivers, the devastation lasts a lifetime.

As lawyers, we play a small part in helping parents, children, aunts, uncles, grandparents – all those significantly touched by the loss – get through the difficult months and years. It’s a sensitive, emotionally charged time for all. And we recognise that, for all the legal options we can offer, what clients want more than anything is to turn back the clock.

That said, there are very good reasons to pursue a claim for compensation. Money will not make up for what has happened but, with the right guidance and support, families can really benefit from a financial settlement that eases some of the day-to-day pressures and provides for their future.

A claim for death by dangerous driving, also known as a fatal accident claim, is usually made against the driver’s insurer. It can provide some family members with compensation for the pain and suffering that has been gone through, and for certain financial losses – loss of income, for instance - that are attributable to their loved one’s death.

As you might expect, the type of claim that a person is able to bring will depend on the circumstances of what happened, and on their relationship to the person who has died. There are many different elements to consider, and an experienced personal injury solicitor will advise on the possibilities and on the best course of action. They will also work hard to bring about a fair settlement as quickly and painlessly as possible.

The reality is that a claim will take time, and it will present challenges. You might even find yourself having to go to court. But understanding all of this from the outset will enable you to properly prepare yourself and to tackle each stage of the process with confidence. And remember that personal injury solicitors like us are specialists – not just in the law and its application, but in the human aspects of every case. It means that you will be supported and protected every step of the way.
