If you are about to go through the probate process, there’s a reason why you may want to begin very soon.  

From 13 July 2026 the probate fee (the amount you have to pay when making the application) will increase by 75% as part of a larger-scale increase in court and tribunal fees. The current fee of £300 will rise to £526 – a not insignificant jump, and one that will be felt by families at a particularly difficult time in their lives.

The Ministry of Justice (MOJ) has said the raft of changes are being made to “strengthen cost recovery, improve consistency in how and where fees are charged, and maintain fair access to justice for all.”  

The probate system has been heavily criticised for its delays and backlog, but it seems rectifying this is on the agenda. Of the probate fee rise specifically, the MOJ said:

This recovers the cost of an ever-improving service, and the new cost accounts for rising inflation as well as investment in delivering an efficient and modern service.”

It remains to be seen whether the systemic issues will be resolved with the help of the extra money generated. However, for now, our focus is on ensuring our clients are best supported as they navigate the aftermath of a loved one’s death. For those dealing with estates valued at more than £5,000, the new fees are something to bear in mind (estates worth less than £5,000 don’t attract probate fees).
