Since October 2007, if you received care for primary health need anywhere in England, the NHS must pay for this and cannot apply means-testing to this primary need.

It is important to understand the distinction of a primary need, as this may be the phrase the NHS used when turning down your application for payment of care home fees.

A primary health need is where your physical or mental need is a result of a disability, accident or illness and that need is the main reason for needing care.

If this is the case, there is a good chance you can claim back your relative’s care home fees. We can help you to move forward with getting your relatives free ongoing care and recover any money they have already paid for their care.
