Most of us think ahead to try and build a picture of what our lives could look like in years to come. While it’s important to plan for financial security, it’s also a good idea to consider how mental and physical health could decline. And one particular concern some people have is the potential loss of autonomy when it comes to healthcare.
A living will is a way of making certain wishes about medical treatment known to those around you. Also known as an ‘advance decision’, a living will can bring peace of mind. It can be a comfort to those who feel strongly that they wouldn’t want certain medical treatments in the future.
Why do people make living wills?
Having a living will means you’ll be heard even if you become unable to communicate. If you know, for example, that you wouldn’t want to be resuscitated if you were you to become terminally ill and non-communicative, your living will could make that clear.
When does a living will come into effect?
Once a living will has been signed (and witnessed), it can begin to apply. Not everyone who makes a living will needs to rely on it, however. Where a person retains their mental capacity and ability to communicate healthcare decisions, the living will is not needed.
Is a living will legally binding?
Yes, if it has been properly prepared. Specialist solicitors like us ensure all formalities are dealt with so that the terms of the living will can be put into effect, if it becomes needed.
Who needs to know about a living will?
It can be a good idea to talk to family members about the plan you are putting in place, so that they understand your reasons. It is also wise to speak to your GP or other healthcare professional, to make sure you understand the implications of refusing particular treatment.
Can a living will be changed?
Yes. If you have a change of heart and decide you don’t want the living will anymore, we’d help you revoke it. If you want to modify your living will, that can could be done too. It’s actually important to review your living will periodically to make sure it reflects your wishes.
